Firstly, all design work belongs to the creator, Dana Fox of Envye (by Wonder Forest) and the copyright shall remain so even after purchase. Please refrain from copying and claiming work as your own. Reselling is not permitted. Any copying or resale of work will result in legal action.
By purchasing any of the designs on my site, pre-made or otherwise, you are agreeing to these terms and conditions of use.
Sharing of files is not permitted. Please direct your friends to this website instead of sharing your files.
PREMADE TEMPLATES
Premade templates are downloadable in .zip format and may be used by a single person or business. You are purchasing a single license to use the product for personal use. Using the same template on multiple sites will need an additional license (please contact for details). Resale or distribution of your purchase is strictly forbidden and considered copyright infringement. You may alter the design header or other elements to suit your blog’s individual needs, but please note that any changes to the code or design will be unsupported by Envye. Copyright notices must stay in place on all templates for legal reasons.
DESIGN SKILLS AND HELP
Some elements for purchase on this site assume that you have at least some Photoshop or photo editing knowledge and basic blog customizing skills. There are optional installation packages available for some services if you need a hand in this area. Refunds will not be rewarded for incompetency or lack of knowledge about the program or service that your product was designed for. Unfortunately, Envye is not able to answer individual questions about Photoshop help or coding. Please do not purchase these items until you have some experience with these things, know somebody that can help you, or alternatively you can purchase the installation service. The FAQ page also offers answers to common questions and how-tos.
REFUNDS
Refunds will not be given due to the digital nature of the files, unless an item is grossly misrepresented or not in a functioning state. Once an item is downloaded, unfortunately there is no way to “return” it and thus returns will not be accepted. Please read through the descriptions of products as well as the FAQ page before proceeding with your order. Any chargebacks placed via Paypal or your Credit Card company will be forwarded to our legal department and will be invoiced for any fees incurred by Paypal ($25 per disputed transaction). By purchasing, you understand and agree that no refunds will be requested and no chargebacks will be placed through Paypal or your Credit Card company. If you have an issue with your order, please be sure to contact Envye first so we can resolve it.
STANDARD CUSTOM DESIGN POLICIES:
By accepting these policies electronically or in writing, and/or by hiring custom design services, you (Client) agree to be bound by the following terms and conditions. You also agree that your electronic acceptance of these terms shall have the same force and effect as if you had agreed to these terms in writing.
Failure to comply with the terms may result in termination of design. By agreeing to these terms, you are allowing Envye to place a copyright/”designed by” logo or banner on your completed blog, website, WordPress or shop design, including, but not limited to Big Cartel, and Storenvy. This copyright link must not be removed as per the terms of this agreement and legal copyright reasons.
Before any design work begins, payment must be received in full. Completing payment ensures that I can set aside the appropriate time needed for your design and covers all costs. Once payment is made, your project will be added to the queue to begin within the timeframe stated on the product page. All payments will be paid through Paypal.
Any additions or changes requested outside of the scope of the original sale will be billed at my standard hourly rate. I am not obligated to complete Client requests or changes outside of the scope of original work or the original invoice quote.
There will be NO REFUNDS of any kind for websites, blog designs, banners, and all other services listed above that have already begun or completed the designing process. All hours of designing work put into each project have to be accounted for. Unlike a product, I am providing a service which is my sole source of income and the time and effort cannot be refunded. If Client has received an initial or completed design, I am in no way obligated to refund complete payment. By accepting these Terms of Service, you are agreeing that no chargebacks will be placed or refunds be demanded. Failure to meet these terms could result in legal action. Refunds will only be given if a project has not yet entered the design queue.
I reserve the right to change prices at any time including hourly design fees.
Timelines are not guaranteed though I strive to meet them. Please always respond in a timely manner to emails once the designing process has begun. Clients that take extended amounts of time replying between emails may be pushed back in the queue. If I have not heard back from Client via email in over one (1) month, project will be considered complete regardless of progress.
Client hereby gives permission for me to use samples or links to Client’s custom designed work for marketing and advertising purposes, including but not limited to use in my online client portfolio.
You understand that any changes to third party software including but not limited to Blogger, Big Cartel, Etsy, and Storenvy are not the responsibility of myself and that I have no control over changes made to their coding structure. YOU UNDERSTAND THAT ANY FUTURE DOWNTIME OR SUDDEN CHANGE TO THE WAY YOUR PAGES ARE DISPLAYED IS NOT A FAULT OF MYSELF, BUT A RESULT OF THIRD PARTY UPGRADES TO THESE SERVICES. I WILL NOT BE HELD RESPONSIBLE FOR THESE CHANGES NOR BE LIABLE TO REPAIR THE AFOREMENTIONED CHANGES. YOU AGREE THAT ANY EDITS OR CHANGES INITIATED AFTER YOUR COMPLETED PROFILE HAS BEEN PUBLISHED TO THESE THIRD PARTY SITES MAY RESULT IN ADDITIONAL COSTS AND/OR FEES. YOU ARE AWARE THAT NO REFUNDS WILL BE GIVEN WHATSOEVER IF THESE CHANGES OCCUR.
PLEASE ALWAYS BACKUP YOUR BLOG OR WEBSITE BEFORE MAKING CHANGES TO THE DESIGN OR CODING. BROKEN PAGES AS A RESULT OF INEXPERIENCED ATTEMPTS AT DESIGN/CODING UPDATES ARE NOT MY RESPONSIBILITY TO FIX AND ARE NOT INCLUDED IN YOUR DESIGN PACKAGE.
You agree to defend, indemnify and hold harmless myself and my business from and against all claims and expenses, including attorney’s fees that may arise or result from any Content you submit, post, transmit or make available through the design Service, from any product sold by Client, its agents or employees or assigns, from any Service provided or performed or agreed to be performed by myself or from your violation of the Terms or your violation of any rights of another.
The Terms of Service agreement shall be governed by the laws of the Province of Ontario.
Envye reserves the right to modify this Agreement at any time without giving you prior notice.
By purchasing clipart from this shop, you are granted non-exclusive, non-transferable, revocable, one-person license to use the artwork. Please note that this is license to use the artwork, NOT an agreement of ownership. All rights, title, interest, copyrights and intellectual rights are retained by Envye by Wonder Forest.
You may use clipart for:
1. Personal use.
2. Small quantity craft handmade tangible items not for sale online. Printing work containing these images in excess of 2000 times need an Extended License
3. Small quantity printed items for personal use such as printed stationery, handmade or printed cards, brochures, flyers, jewelry, pendants, etc.
4. Personalized printed and digital flattened jpg invites, printed and digital flattened jpg photo cards for personal non-commercial use.
5. Blogs and websites – flattened design (JPG, GIF or PNG format) in resolution NOT greater than 72 DPI.
You may NOT Use clipart for:
1. Selling artwork AS IS or ALTERED and claiming as your own. All copyrights remain with Envye by Wonder Forest at all times.
2. You may not re-distribute the files in their original form. You are not allowed to sub-license, re-sell, lend, assign or gift clipart. You cannot distribute or publish the product as is.
3. Sharing any of the artwork as freebies and downloads.
4. Layered templates made for resale. The artwork may NOT appear in any layered files.
5. Turning any designs into rubber stamps, polymer stamps, acrylic stamps, etc. for selling.
6. Mass producing products.
7. All items made for sale require purchase of the Extended License (see below).
8. You may not sell posters and art prints of this work without obtaining the Extended License
9. You may not make iPhone cases, T-shirts without obtaining the Extended License.
10. You may not create design templates for sale, either on-line or off-line, including but not limited to website templates, blog templates, flash templates, business card templates, e-card templates and brochure design templates, without obtaining the Extended License.
